PART TIME EMPLOYEES PAID HOLIDAY PAY FOR ENTIRE SHIFT

AFGE NV 1240 Steward, Heather Porter, has settled a issue regarding Holiday Pay for Part-Time Officers who work overlapping shifts. It has been decided that Part-Time Officers will be paid Holiday Pay for their entire shift if the Holiday is their RDO. Management has agreed to make corrections for Pay Period 1 time cards to allow Holiday Pay for the entire shift. If you are a Part-Time Officer with issues, please contact ETAS for PP1 corrections.

Heather, We have verified the applicable policy with HQ and have made corrections to PP 1 time cards to allow for Holiday Leave pay (for the whole shift) in situations when a PT employee performs scheduled work on any part of a holiday even when that Holiday is a scheduled RDO (i.e the overnight shift of your employee from Sunday into the holiday Monday) . We are still engaged with HQ to work an audit on previous time cards however that will take more time.

Hello, this is TSO Heather Porter, Union Steward with AFGE Local 1240. I am writing you today because I have an officer who has a pay issue that needs to be handled. Now she has already filed a grievance with the NRC and was told her case is closed because pay issues cannot be grieved because of John Pistole's Determination he passed before he moved on. She was told to handle it at a local level, hence the reason for this email. This officer has been with TSA since the organization was formed and was hired as a full-time officer, but became a part-time officer on 06.17.2012. She has mainly worked from 2000-0100, but is currently working 2330-0500 with Monday, Tuesday and Wednesday off. She has been told numerous times by officers in ETAS (Perlie Reyes, Will Castagnino, and others) as well as payroll (Charles Whitaker) that a part-time officer gets paid holiday premium pay only if they work on that holiday. Well, after doing research I came across TSA MD 1100.55-8, Handbook Premium Pay. In this handbook on page 28 of 55, (a) (1) it states:

An FT or PT employee who performs approved non-overtime work on a holiday will receive pay at his or her rate of adjusted pay, plus holiday premium pay equal to his or her rate of adjusted pay. Therefore, an employee working a conventional 8-hour tour on a holiday will receive "double time"-- eight hours of pay that all employees receive on the holiday, and another eight hours of pay for working on a holiday.......(Continued on page 29) An employee does not have to work a full tour of duty in order to receive holiday pay for holiday work. If any portion of the employee's normal tour falls on the holiday, the employee is entitled to receive holiday pay for the entire tour.

It goes on to list an example: If an employee's tour of duty includes a shift from 6:00pm on a Thursday to 02:30am on Friday, and Friday is a holiday, the employee will receive holiday pay for the entire shift.

Now I know the examples are listed in a full-time status, but it refers to an FT or PT employee in the first line of the paragraph.

So since this officer works on a Sunday night into Monday morning from 2330-0500, and Monday is a holiday, even though her RDO is a Monday, she is still entitled to all 6 hours of holiday premium pay as well as her regular pay.

This is a clear violation of this MD, and I am not sure how long this issue has been going on or how it started, or how many other officers it affects, but I know she is not the only one. Since this has been brought to my attention, and since the grievance was originally filed in Nov 2014, she has calculated 37 hours of holiday pay that she is owed since switching to part-time 06.17.2012. That's not including the most recent holidays that have passed since Nov 2014. I hope that this issue can be resolved, and this officer can be back paid and from this point forward this MD be adhered to. I have paperwork to support the holiday hours she didn't receive and is entitled too if need be.
